TERMS & CONDITIONS
Term
This engagement shall begin on the date that this Agreement is signed and dated by The Talent and countersigned by a representative of Fresh Talent, and shall continue until terminated by either party in writing.
Representation
- The Talent, grant Fresh Talent the exclusive right to act as an agent representing The Talent to any person or organisation to procure performance or creative work for me.
- The Talent also understands that this agreement is for the provision of The Talents Services as an independent contractor and not an employee. All fees paid to The Talent under this agreement with the Agency will be paid to The Talent taking into account that any contracted work is for the provision of The Talents Services as an independent contractor. Accordingly, The Talent understands that they are not eligible for any additional payments in the nature of holiday, sick pay or the like.
- The Talent understands that they will be liable to pay their own ACC levies as an independent contractor on the WT tax code.
- The Talent also understand that Fresh Talent will represent The Talent to the best or their abilities, but in no way can guarantee ongoing steady work due to the contractual nature of the business.
Commission
The Talent, agree to Fresh Talent deducting 20% of The Talents total gross fees, (including all ancillary fees, royalties and residuals) receivable by The Talent for any performance or creative work arranged by Fresh Talent.
Join Fee
ADULTS: $99 – 18 years or older CHILDREN/TEENS: $49.50 - 17 years or younger
The joining fee is a one-off payment that gives the Talent a life-time membership on Fresh Talent’s books.
Money Back Guarantee Conditions
If Fresh Talent do not offer the Talent work within 6 months of joining, then the Talent will be given a FULL REFUND of the joining fee paid. In order for this money back guarantee to apply, Talent must meet the following criteria:
(a) be 18 years or older
(b) have their own reliable transport
(c) have great availability during the week
An offer of work regardless of whether the talent takes the work or not, will deem that Fresh Talent to have fulfilled their obligation in regards to the ‘Money Back Guarantee’ conditions.
Confidentiality Policy
- All work, and all information including audition information, scripts, fees, budgets or any other information written or otherwise, received by The Talent in the performance of this Agreement, or in the provision of services to any client, shall be treated as strictly confidential by The Talent and shall not be disclosed to any third party, nor used for any other purpose other than to provide performance and creative services.
- The Talent confirms keeping confidential all information concerning the Producers business and the Production, including, but not limited to, details of scripts and future development, casting, budgets and including, without limitation, in respect of blogs and social networking sites.
- The Talent also understands the obligation not to disclose any information about the Production, characters or storylines to a third party either during the contractual period or after it.
- The Talent also understands that it is strictly prohibited to bring any cell phones or recording devices of any kind on set or location, therefore understands that taking photos still or moving or sound recordings of any kind and publishing them in the public arena will result in instant termination of the contract with Fresh Talent and could result in legal proceedings against said Talent.
Production Release Forms / Agreements & Time Sheets
The Talent are to strictly adhere to the terms and conditions of any release forms or agreements The Talent signs for each Production. It is also the sole responsibility of The Talent to sign the ‘time-sheets’ also referred to as the ‘sign in and out forms’ to validate the hours on set or location. Failure to sign these forms means the Production nor Fresh Talent are obligated to pay The Talent any previously agreed fees.
Code of Conduct Policy
- The Talent are expected to be punctual, courteous, and behave in a manner that is not detrimental, abusive or offensive to the production, crew, other extras, actors and any other production staff.
- The Talent must not be under the influence of drugs and alcohol whilst contracted for Services under the representation of Fresh Talent on a Production.
Breaches of this Agreement
A breach of this Agreement involves contravention of all of the above obligations. If established, breaches of this agreement will lead to instant termination of your contract with Fresh Talent and any registration fees already paid will not be refunded.
Termination of services
Fresh Talent reserves the right to terminate this contract and remove The Talent from our books and website at our own discretion and no correspondence shall be entered into. If, Talent wishes to be taken off the books, notice must be given either written or verbally. No termination fees apply.
Criminal Convictions
The Talent declares that they have not been convicted of any criminal offense or knowingly undertaken activities that may have adverse consequences for Fresh Talent, or their clients or client company or product if the Talent’s performance or image becomes public.
The Talent will inform Fresh Talent immediately if they become convicted of a criminal offense.
